The Antiquity Certificate is the document needed at the Notary to update the Title Deeds with any alterations introduced to the property, such as pools or extensions done with or without a license.
The Architect certifies the date of construction which serves as proof of prescription of a possible planning infraction, subsequently, once done any fine is the Architect’s responsibility. In the case of having done an extension or pool without a license, the Antiquity Certificate is very useful to guard against possible sanctions and highly recommendable to avoid putting off potential buyers due to the existence of undeclared buildings in Title Deeds, even if done with license.
Once confirmed, we will arrange an appointment to survey the pool/extension requiring only your NIE and current Title Deeds. The certificate, stamped by the Official College of Architects, is delivered within 7/10days, then the applicant can either go ahead and update the Title Deeds or wait for change of Property Titleholder/s at the Notary. The price of a Pool Antiquity Certificate is 190€+IVA and Extensions 250€+IVA. Only condition is that declared building is over 4 to 10 years, depending on the area.

NEW VALENCIA LAW CHANGES THE MINIMUM TIME FROM 4 TO 15 YEARS TO LEGALISE BUILDING WORKS, NOT APPLICABLE IN MURCIA OR ALMERIA by Martinez de la Casa Architects

This new law which became applicable on the 20th August of this year, greatly affects the international community in Alicante. Exactly the same as in Murcia and Almería, up until now, any building, extension or pool could be legalised or it's description updated in the Title Deeds and afterwards registered in the Land Registry once it was 4 years old (with the exception of protected / special areas / inhabilitating participation quotas in Deeds). The only document needed was an Antiquity Certificate stating the building was over 4 years old. FROM NOW ON THIS PERIOD HAS EXTENDED TO 15 YEARS IN ALICANTE, CURRENTLY REMAINING THE SAME IN MURCIA (ANTIQUITY CERTIFICATE STATING OVER 4 YEARS).

Therefore, in Alicante area, all extensions made in LESS THAN 4 years BEFORE May 2014 cannot be registered until 15 years old, generally except having Antiquity Certificates issued before 20th August or proving alterations/extensions were done before 4 years prior to the new law.

The rest of the process remains the same; needing an ANTIQUITY CERTIFICATE done by an Architect, at the Notary to update the Title Deeds (Escritura) with any alterations introduced to the property, such as pools or extensions done with or without a license.

In the case of having done an extension or pool without a license, the Antiquity Certificate, frecuently known by the general public as “RETROSPECTIVE LICENCE”, is also very useful to guard against possible sanctions/fines, and to protect/state the legal situation of the property in case the law was changed in Murcia also.

In any case it's highly recommended to avoid putting off potential buyers, due to the existence of undeclared buildings even if done with a license, to have your Antiquity Certficate ready. In the case that registration is not possible, the Antiquity Certificate serves to offer any potential buyer the maximum possible security against Townhall penalties.

In Murcia and Almería this new law IS NOT APPLICABLE (ALTHOUGH MURCIAN LAW COULD ALSO CHANGE), THEREFORE BEING ABLE TO REGISTER IN THE LAND REGISTRY EXTENSIONS, POOLS OR ANY OTHER ALTERATIONS DONE TO THE PROPERTY VIA AN ANTIQUITY CERTIFICATE 4 YEARS (MURCIA) or 6 YEARS (ALMERIA) AFTER HAVING THE WORKS DONE.

If you want to have certified your extension or pool now, considering that in Murcia and Almería it is still possible in accordance to present laws (and protect against possible future changes in the laws that may effect you) and you wish to have your Antiquity Certificate issued now, Martinez de la Casa Architects will arrange an appointment to survey the pool/extension requiring only your NIE and current Title Deeds. Later using satelitte images and software we check the age of the pool/extension (pictured is an example used in the process for Antiquity Certification) and combine this with the measurements and documentation taken during our on-site visit. The Antiquity Certificate is stamped by the Official College of Architects and delivered within 7-10 days. The applicant can then either update and register the Title Deeds, or wait for change of Property Titleholder's at the Notary.

Due to the great upsurge in requests for Antiquity Certificates in response to this law change within Alicante, (and with property owners in other regions, Murcia and Almeria, also foreboding the law could change for them too in the near future), Martinez de la Casa Architects has been able to greatly reduce prices; therefore the price of a Pool Antiquity Certificate in all MURCIA, ALMERIA AND ALICANTE are now at 190 €+IVA (previously 250€+IVA), and for Extensions plus Pool, or for the complete property, we can now offer the Antiquity Certificate at 270 €+IVA (previously 353 €+IVA). The only condition in Murcia according to the current land law is that the building/pool to certify was built over 4 years ago. Occupation Licenses in ALicante by Martinez de la Casa Architects

An Occupation License is a document broadly used by Townhalls in Alicante for several issues. Currently the submission (registration receipt) of having applied for an Occupation License (not the license itself), is required to sign for a property sale at any Notary within Alicante. The document, also called Habitation License or Habitation Cedule, is required in other regions too, to deal with electricity contracts or arrange water supplies.

This document/receipt is achieved by submitting a dossier with the compilation of the Title Deeds, water and electricity bills, annual Townhall tax, and NIE, one or more certificates by an Architect and sometimes complete plans of the property. Requirements vary widely among municipalities.

■ Paperwork for Reconocimiento de Edificacion Existente (necessary in Almeria region) __________353€*+IVA (underbudget)

AFO (Asimilado Fuera de Ordenacion), meaning “assimilated to out of ordination” is a special regime by the ANDALUCIAN GOVERNMENT created as an attempt to regulate the situation of a large number of not completely legal properties. Therefore affecting homes with wrong use classification, done without a license, without Occupation License etc, or for parts of the property (such as extensions or pools) that are located basically on non-residencial areas (rustic land), solving social, environmental and urban problems.

AFO is defined in Article 53 of Decree 60/2010, 16th March, and is now increasingly required or enforced by local authorities for the following:

* Access to basic services such as water and electricity, with utility companies.
* Municipal license for maintenance or building works, of any scale.
* Solictors increasingly request it and it can also be required for a mortgage.

The AFO CLASSIFICATION of a property is achieved by submitting a dossier with the compilation of the Title Deeds, utility bills, annual Townhall tax (IBI), and NIE, one or more certificates by an Architect and complete plans of the property. Requirements vary widely among municipalities and regions, as does the registration tax or Townhall fees, which can be quite expensive. It's also hard to give a concise guide relating to the indepth requirements and cost of an AFO due to property size, age, design, type and location.
